Club Kapok Loyalty Program Terms and Conditions:
These terms and conditions (the “Terms”) outline the rules and regulations that apply to your application to join Club Kapok. You must read and understand the Terms carefully. By submitting the application to become and/or successfully registering as a member of Club Kapok, you agree to be bound by the Terms.
- Definitions
Unless otherwise defined, these terms should have the following meanings:
- “Club Kapok” is an integrated loyalty program operated by Kapok Limited for kapok stores (as defined herein after). Club Kapok and kapok stores may also be referred to as "we," "us," or "our," as applicable.
- “kapok” refers to Club Kapok, kapok stores and Kapok Limited.
- “kapok stores” means retail and online stores/any sales channels directly operated by Kapok Limited in Hong Kong, unless it is expressly excluded by kapok from time to time.
- “qualifying acts” means the acts that generate points
- “qualifying spending” means the purchases or spending that generate points.
- A “Point” or “Points” in plural refers to a point earned in Club Kapok integrated loyalty program with 1 point earned for every HK$1 spent at any kapok stores. There is no minimum spending requirement on point registration via Club Kapok App (“the App”).
- A “Bonus point” refers to a point gifted by kapok for member upgrading, birthday celebration and campaigns (if any).
- “Offers” means goods, service, coupons, gifts, benefits, or privileges of any type or nature available for members under Club Kapok.
- “Kapok dollars” means virtual dollars redeemed by certain points.
- “Rewards” means points earning campaigns which may be organized or arranged by kapok from time to time.
- “Free gift” refers to the gifts arranged by kapok for member upgrading, birthday celebration or other specified campaigns.
- “Merchant” means a seller or supplier that has entered into an agreement with kapok to provide Offers to members.
- Club Kapok Membership
- Customers must first register as members of Club Kapok (“Member”) through the App by providing the required information.
- The registered Member name must be the same as the one stated on the Hong Kong Identity Card, Passport or other official documents of the same kind.
- Members who are under the age of 18 must obtain consent from their parent or guardian before applying for a Club Kapok Membership.
- Members must register a correct and valid mobile phone number from Hong Kong, Mainland China, Macau and other regions. Members must be the legitimate owner of the registered mobile phone number.
- Members must register an email address that they frequently use.
- We take no responsibility for any undelivered SMS, push notifications or emails regardless of whether the registered mobile phone number or email address is correct or not.
- Members must ensure that the information submitted on the registration form is authentic, accurate, complete, not misleading and without any elements of fraud.
- We reserve the sole and absolute right and discretion to determine a person’s eligibility for the membership and forfeit the welcome offer without prior notice.
- The mobile phone number or email address submitted for registration must be correct and valid and registered under the name of the applicant. A virtual mobile phone number or email address is not acceptable for membership registration.
- Club Kapok, kapok stores and Kapok Limited will not be held liable for or responsible for compensating the Members in any manner for any loss or damage due to any unauthorised access to Club Kapok App for whatever reason including but not limited to stolen or lost mobile devices and/or failure to inform Club Kapok after a change of the registered mobile phone number or email address.
- Upon successful registration, Members may be required to rectify their birth month in person at any kapok retail stores. Changes of this nature will only be processed upon submission of supporting documents that verify the requested update to personal information.
- Membership and Point are non-transferable.
- Members should refresh their Point records and details after any updates. Except for manifest errors, all Member data, bonus point and redemption records kept by us are final and conclusive.
- Members are required to maintain strict confidentiality and security of their membership numbers, passwords, and email addresses. Members are fully responsible for any unauthorized use of their accounts, whether with or without their authorization, by any individual, including third parties. We will not be held responsible for any loss or damages incurred for such unauthorized use.
- Staff at kapok stores are authorized to request Members to present a valid identification document to verify the accuracy of Member data displayed on their mobile devices.
- We reserve the right to suspend or terminate any membership without any prior notice if a Member uses or access without authority any accounts that belong to another person, or is found to be dishonest providing false information in his/her application for membership, or be dishonest in exercising of Member privileges.
- Members can choose to delete their account and cancel their memberships through either one of the following means from 2.17.1 to 2.17.2, while the account deletion request will be processed within 3 days.
- Send an email to support@ka-pok.com. The content must include the membership number, Member name, registered mobile phone number and email address used for identity verification, or
- Submit an account deletion request through the App.
Upon account deletion or any other termination of membership, any unredeemed Points, unused coupons and cash dollars, uncollected rewards in the Member’s account will be forfeited without further notice.
- Membership types and Membership Tiers
1. kapok has the right to set and vary, from time to time as it considers appropriate, the membership types and the membership tiers and the respective entry criteria.
2. The individual membership is the only type that is currently available
3. The following membership tiers are currently available:
(a) Canvas
(b) Pod
(c) Thread
(d) Bloom
4. Upon successful registration and activation of membership in Club Kapok, all Members will be immediately granted with the membership. By satisfying the entry criteria prescribed for a specific tier, a Member will be accordingly upgraded to that tier of membership and start enjoying the benefits associated with that tier of membership. Unless specified otherwise by kapok, the entry criteria can be satisfied only by accumulating a specified number of Points from making qualifying acts and /or qualifying spending within a specified period of time.
5. kapok has the right to designate and change from time to time the membership tier of a Member having regard to the entry criteria. For the avoidance of doubt, kapok has sole discretion not to change the membership tier of a Member even if the entry criteria of another membership tier become applicable.
6. A membership year last 12 months. Once a Member is upgraded to any tier above Canvas, he/she will be entitled to remain in that upgraded tier for his/her membership year and receive the corresponding tier benefits. The membership tier of a Member will be re-assessed and re-designated on the membership year expiry date.
7. Notwithstanding the above, Members who do not make any qualifying acts and /or qualifying spending may remain in the Canvas without date of expiry and can resume earning points at any time, unless and until their memberships are terminated for any reason.
- Point
- Generally one Point will be credited to a Member account for every net amount of HK$1 dollar spent by the Member making qualifying acts and qualifying spending at kapok stores. kapok has the right to set and vary, from time to time as it considers appropriate, the types and other details of qualifying acts and qualifying spending and the arrangements that apply generally or apply to specified kapok stores or specified membership type or membership tier.
- kapok will publish the details of the qualifying acts and the qualifying spending and how they are converted into the Points. Qualifying acts may include registering the Club Kapok account, referrals, campaign sharing. Qualifying spending may include purchasing products at kapok stores or redeeming goods or service via the App.
- Each Member may generate Points by making qualifying acts and /or qualifying spending. The Points generated by a Member will be credited to his/her Club Kapok account. The records maintained by kapok about the Points generated by a Member and how they have been used or handled shall be conclusive and binding on the Member save for any manifest error.
- If Member’s qualifying act or qualifying spending is ineffective, cancelled or reversed for any reasons, kapok has the right to cancel the Points generated by such qualifying act or qualifying spending and adjust its records and the Member account accordingly. If there are insufficient Points in the Member account for cancellation, Member will have to reimburse kapok for the equivalent value of the Points if required by kapok.
- Points will be awarded in decimal place while the decimal place will not be shown on the App. To illustrate, if the net purchase amount is HK$99.9, then 99.9 points will be awarded and showing 99 on App.
- Points will be awarded and updated within 2 hours from the time of a Member’s purchase or payment. The Member may check his/her Points balance at the App.
- kapok has the right to specify expiry date for the Points. Unless otherwise specified, Points are valid for 365 days from the date of award, after which they will automatically expire. To illustrate, if a purchase is made on 1st Sep 2024, the Points of awarded for that purchase will expire on 31st Aug 2025. Expired Points will have no effect and cannot be reinstated nor exchanged for cash.
- kapok reserve the right to exclude any services or products for generating the points in its sole discretion. Notices of such exclusion will be posted on kapok website, the App and/or in kapok retail stores from time to time.
- kapok reserves the right to deduct the Points from the relevant Member account if it knows or reasonably suspects that such Points were obtained via fraudulent or dishonest means or in any manner that is not in accordance with these Terms or any other terms and conditions applicable to the relevant offer or rewards
- kapok shall not be liable for any loss of Points or loss or damage suffered by a Member as a result of a technical defect or error that prevents kapok from retrieving, processing or recording information relating to the Member’s Points balance from its computer systems.
- Records relating to the Points shall be shown on the relevant Member account via the App. kapok has no obligation to provide such records in a printed format or any other format.
- It is necessary to present e-membership card and /or provide Member account information as requested by kapok staff for purposes including enjoyment of Club Kapok offers (including coupons, cash dollars, gifts), rewards or benefits.
5. Offers
1. kapok has the right to set and vary, from time to time as it considers appropriate, the arrangements and conditions for redeeming offers. Broadly speaking, Member have to hold a valid Member account and provide proof of membership (if requested) in order to redeem offers. kapok may prescribe arrangements and conditions to apply generally or apply to specific kapok stores or specified membership type or membership tier.
2. kapok will publish the details of the arrangement and conditions from time to time, including any of the following:
(a) The redemption method, whether offers may be redeemed by the Points only or by any other method including payment by any means or by a combination of Points and payment by any means;
(b) The offers that may be redeemed and the kapok stores from which the offers may be redeemed and;
(c) Any limits on redemption, whether by way of value, quantity, redemption period or in any other form or nature.
3. By submitting a redemption request, Members agree to redeem the offer specified in the redemption request on the conditions applicable to that offer. Once Member submit a redemption request, Member cannot revise or cancel it without kapok’s consent.
4. kapok will notify Members after receipt of a redemption request setting out the details, including the offer to be redeemed, the necessary Points and/or payment, the redemption request processing status, and the delivery or collection arrangements. kapok may send the notification by such means as it may prescribe, including by email, SMS, or via the App. Where a redemption request is successful, Member will receive the e-coupon with QR code via the App to enable to claim the offer. The e-coupon with QR code is for one-time use for the specific redemption request only and cannot be exchanged or converted to cash.
5. kapok does not guarantee the availability of any Offers, whether provided by kapok or any other Merchants. Where an offer is provided by a Merchant other than kapok, kapok does not guarantee the quality of the offer whether or how the Merchants perform. You should resolve any complaint or dispute relating to the offer provided by the Merchant directly with the Merchant.
6. Where a redemption of offers is subject to stock or quota, please check with kapok whether the offers are available before making a redemption request.
7. kapok reserves the right to reject or cancel any redemption request received if it considers appropriate, including where there is insufficient stock or quota, where delivery service is not available, or where the amount of Points and/or payment required for redeeming the relevant offers as published by kapok is incorrect due to any error or technical defect.
8. kapok accepts payment using specified credit cards or electronic payment facilities. In using such credit cards or electronic payment facilities, Members are solely responsible for performing the resulting obligations and complying with the agreement or terms and conditions governing them as prescribed by the issuers of the credit cards or the electronic payment facilities.
9. kapok may (but is not obliged to) provide or arrange for delivery services. kapok is not responsible for the availability nor the performance of any delivery services. Please check with kapok whether delivery services are available and the delivery arrangements (including whether delivery fees are payable) before making a redemption request.
10. Offers redeemed cannot be returned or exchanged unless specified otherwise by kapok and subject to such terms and conditions as kapok may consider appropriate (including the time period within which a request for return or exchange must be made, the criteria qualifying for a return or exchange). Member may be required to bring the goods in person for inspection at one of the designed kapok retail stores.
11. Offers redeemed cannot be refunded (including delivery feed paid)
12. Redeemed coupons cannot be converted to cash or exchanged for cash.
6. Kapok Dollars:
1. Members are welcome to redeem Kapok Dollar with their earned Points via the App, the corresponding Points will be deducted instantly from the Members’ accounts. No cancellation or Point refund is allowed.
2. For every 100 Points earned, Members can convert them to $1 Kapok Dollar, and every $1 Kapok Dollar is equivalent to HK$1 at kapok stores.
3. kapok has the right to set and vary, from time to time as it considers appropriate, the arrangement and conditions for Kapok Dollars
4. kapok will publish the details of the arrangement and conditions from time to time, including any of the following:
(a) Conversion rate;
(b) Applied membership types and membership tiers
(c) Limitation of Kapok Dollar on each transaction for any special programs, facilities, and promotional activities.
1. In any transaction settled by Kapok Dollar, the transaction amount must be equal to, or higher than the amount paid in Kapok Dollar.
- Spending made using Kapok Dollar will not be considered as qualifying spending for the purposes of Point generation, redemption programs and promotional activities organized by Club Kapok.
- Under any return circumstances, payment made using Kapok dollar will be refunded in credit note at participating retail stores.
- Kapok Dollar cannot be used for any transaction of value-adding services, purchasing coupons/ e-coupons/ gift vouchers/ gift cards and membership fee payment.
- All Kapok Dollar cannot be reversed, transferred, or exchanged for cash in any circumstances. Any unused Kapok Dollar balance after its expiry date will be forfeited.
- If Member does not report an error in Kapok Dollar redemption to kapok on the same day of issuance of the transaction record, the Member is deemed to have agreed with the details of the Points shown on the transaction record as specified in the App.
7. Bonus Points
1. kapok has the right to set and vary, from time to time as it considers appropriate, the arrangements and conditions for bonus points.
2. kapok will publish the details of the arrangement and conditions from time to time, including any of the following:
(a) Time for Points to be credited to Member account;
(b) Applied specific membership types, membership tiers, and specific stores and/or campaigns;
(c) Valid period
8. Rewards
From time to time, kapok will launch Points earning campaigns as rewards to Members. Members can earn Points by following the steps of specific campaigns prescribed by kapok. kapok will publish the details of the arrangements and conditions from to time.
9. Free Gifts
1. kapok has the right to set and vary, from time to time as it considers appropriate, the arrangements and conditions for free gifts.
2. kapok will publish the details of the arrangement and conditions from time to time, including any of the following:
(a) The redemption method;
(b) Applied specific membership types, membership tiers, and specific stores and/or campaigns;
(c) Delivery or collection arrangement.
(d) Valid period
10. Points and Offers are not Redeemable for cash
The Points and offers have no cash or monetary value and cannot be converted to cash nor exchanged for cash.
11. Your Personal Data
1. You authorise kapok to use your personal data which may be collected or compiled by kapok from time to time for the purposes of Club Kapok, including disclosing your personal data to the Merchants. Please refer to the Customer Privacy Policy of kapok for further details.
2. Subject to your consent, kapok may use your personal data for direct marketing purposes.
12 Liability
1. kapok shall not be liable to any Member for any loss, damages or expenses of any kind whatsoever arising out of or in connection with the Club Kapok Membership or its benefits, including but not limited to the use of personal data, mistakes or fraud by any person in redeeming a benefit, whether kapok is negligent or otherwise.
2. kapok’ liability in contract, tort or otherwise in respect of any claim arising out of acts or omissions relating to the Club Kapok Membership shall be limited to re-crediting the value of the Bonus Points entitled to by the Member in connection with which the matter arises.
3. kapok shall not be liable for any loss or damage arising out of the product or service provided by any other entities including Merchants in connection with the use of the Club Kapok Membership.
4. kapok’s decision in respect of any such complaint or dispute shall be final and binding on the Member and kapok shall not be required to give any reason for such decision.
13 Invalidity
1. The invalidity, illegality or unenforceability of any provision of these terms and conditions under the laws of any jurisdiction shall not affect its validity, legality or enforceability under the laws of any other jurisdiction nor the validity, legality or enforceability of any other provisions herein contained.
14 Jurisdiction
1. These terms and conditions and the relationship between kapok and each Member are governed by the laws of The Hong Kong Special Administrative Region. kapok and each Member shall submit to the non-exclusive jurisdiction of the Hong Kong Courts.
